Terms of Service

These terms define how Blindsmiths is licensed, how data flows through the Service, and what each party is responsible for.

  • You get a limited license to use the Service while your account is in good standing.
  • You own your business data and content; you grant us permission to process it to run the Service.
  • You are responsible for what you upload and for the access you grant to your workspace.
  • We may use third-party providers, including OpenAI, hosting, database, and payment providers, to deliver features.
  • We can suspend accounts for misuse, security risks, or non-payment.
  • Liability is limited as described below.

1. Agreement to terms

By accessing or using Blindsmiths (the "Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

The Service is currently offered to businesses in Australia.

2. Accounts and roles

You must provide accurate account information and keep credentials secure. Roles and permissions are managed by your business. You are responsible for activity under your account and for your users' actions.

3. The Service

Blindsmiths provides voice, photo, and form-based job capture and related operational workflows in a Postgres-backed workspace. Some features rely on integrated third-party services. We may update, add, or remove features to improve the Service or comply with legal requirements.

4. Customer data and permissions

You retain ownership of data you or your users upload, including job details, photos, and audio. You grant us a limited license to host, process, transmit, and display that data solely to provide and improve the Service. You are responsible for obtaining all permissions needed to upload and process customer data.

Customer records are stored in tenant-scoped systems. Postgres row-level security and application roles enforce business isolation. You are responsible for managing authorised users and may request export or deletion of your data, subject to legal and operational retention requirements.

5. Third-party services

The Service integrates with third-party providers such as OpenAI and other AI providers, hosting platforms, database services, optional connected services, and payment processors. Your use of those services is subject to their terms and policies. We are not responsible for third-party services or their outages.

6. Fees, trials, and billing

Fees, included usage, and billing periods are described on the pricing page or in your order form. Blindsmiths is not currently registered for GST and does not currently charge GST. If that changes, we will update the fees and these Terms before charging GST. Trials may be limited in duration or usage. You are responsible for applicable taxes and payment method information. We may suspend the Service for overdue accounts.

7. Cancellations and refunds

Recurring monthly and annual subscriptions continue for the selected billing period until cancelled. A cancellation is scheduled for the end of the current paid billing period, with no proration. Voice packs are one-time purchases and do not renew automatically. Fixed-term and instalment agreements are governed by the applicable order form or agreement and do not renew automatically unless that document expressly says otherwise.

Our cancellation and refund rules are explained on the Cancellations and refunds page. Nothing in these Terms excludes, restricts, or modifies rights or remedies under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

8. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent activity.
  • Attempt to bypass security, access others' data, or interfere with the Service.
  • Upload content that infringes intellectual property or violates privacy rights.
  • Overload or disrupt the Service beyond reasonable, documented usage limits.

9. Security and privacy

We use reasonable administrative, technical, and physical safeguards designed to protect the Service. No system is 100% secure, so you use the Service at your own risk. Privacy practices are described in our Privacy Policy.

10. Support and changes

Support levels depend on your plan. We may modify or discontinue parts of the Service with reasonable notice when feasible, especially for security or legal reasons.

11. Intellectual property

We retain all rights to the Service, including software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.

12. Feedback

If you provide feedback, you grant us the right to use it without restriction or compensation. We are not obligated to implement feedback.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for material breaches, security risks, or non-payment. Upon termination, your access ends and we may delete or anonymize data according to our retention practices.

14. Disclaimers

Subject to the non-excludable rights described above, the Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties that may lawfully be excluded, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

Subject to liability that cannot lawfully be excluded or limited, and to the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amounts paid by you for the Service in the 12 months before the event giving rise to the claim.

16. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your use of the Service, your content, or your violation of these Terms. This clause does not apply to the extent a loss was caused by our breach, negligence, or other liability that cannot lawfully be excluded.

17. Governing law and venue

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. You submit to the exclusive jurisdiction of the courts located in Melbourne, Victoria, Australia.

18. Notices and contact

Blindsmiths is the name used for the Service. Legal notices and enquiries should be sent through the contact portal or by email to Blindsmiths@gmail.com. The legal identity and contact details stated in an applicable order form or invoice also form part of that transaction.

19. Changes to terms

We may update these Terms from time to time. We will post the updated version and update the effective date. Continued use after changes means you accept the updated Terms.
